Resort Worker Gets Relief thru SEnA

Through the Single Entry Approach program, a resort worker was paid P12,396.14 in financial benfits after full compliance to prior agreementsmade with his employer.

 

Alleging for having been illegally dismissed after more than three years of service at the emplyer’s resort and spa, Julius Joseph Inong filed a Request for Assistance on September 9, 2014 at the National Conciliation and Mediation board Regional Branch No. 1.

 

During the initial conference on September 16, 2014, documents show that the notice of dismissal was August 26, 2014 and the effectivity of which is two days after. The management representative explained that Inong have been into a number of violations and have served corresponding suspensions according to company personnel policy.

 

“Some of his violations even warrant outright dismissal based on our policy,” the management representative said who added that she gave him considerations and placed suspension as penalty rather than dismissal.

 

Inong alleged that not all the violations he was suspended for was his direct doing but by some other employee. He also contended for the matter of having been charged of a violation of not completing a required job while serving his suspension.

 

Nevertheless, it was explained to the management representative who was also the HR manager for the resort that the notice of dismissal did not observe the 30-day prior notice before the intended date of termination despite the presence of just cause for doing so. Later she admitted that all the violations with suspensions served by Inong was investigated only after serving the notices.

 

On September 22, 2014, the HR Manager, after having discussed the matter with her superior, disclosed that Inong will be paid his separation pay, cash equivalent of his SIL and proportionate 13th month pay only after accomplishing his clearance and having settled other liabilities from the resort.

 

Inong received his separation pay of P8,000, 13th month pay of P3,467.38 and SIL of 928.76 on September 30, 2014.
