Alleged Illegal Dismissal Issue Resolved with NUEBE Service Cooperative

Region 1 – An account representative allegedly dismissed for no reason got his work back after resolving his issue at National Conciliation & Mediation Board Regional Branch No. 1 through the Single Entry Approach (SEnA) Program.

 

Virgilio Licuanan filed a request for assistance on August 7, 2014 after he has been terminated from work. During the scheduled conference on August 11, 2014, Pure Gold Manager Mr. Paulino Solamo appeared together with Ms. Princess Andrada, HR Manager.

 

Solamo said that Pure Gold is not responsible for said termination. While Licuanan works for Pure Gold, the latter is an employee of NUEBE Service Cooperative who provides manpower services for them. On the other end, Licuanan reiterated that the termination act was initiated by Andrada to which she admitted. Solamo therefore requested for another conference to call a NUEBE representative to help them iron things out.

 

On August 15, 2014, Maricel Concepcion of NUEBE Service Cooperative, together with Andrada, clarified that there is no termination of employment for the requesting party and that he will be able to return to work. They said that the matter was a result of miscommunication.

 

Concepcion further offered Licuanan working opportunities in Metro Manila. The latter gladly accepted the offer.

 

SEADO Corpuz and handling officer AOIV Vincent Remular advised that in cases like this, the principal cannot take the prerogative to fire outsourced employees. They were told to refer the matter to the contracting agency that employed such workers for them to take appropriate action.  

 

The Single Entry Approach is 30-day mandatory conciliation program implemented by the Department of Labor and Employment for speedy resolution of issues arising from employment.
