Cashier Settles Issues With Employer for P30K

A drugstore cashier received P30, 000 to release her employer from all claims she has from the latter.

 

Juvelyn Tavas was given said amount after she and her employer agreed to settle on October 9, 2014 at NCMB Regional Branch No. 1. “Through efforts to make both ends meet, parties were able to put an end to the issue who are also blood relatives,” Director Brenda Rose C. Odsey said.

 

The employer admitted that no mandatory deductions for SSS, Philhealth and Pag-ibig were remitted to said agencies, including underpayment of wages, non-payment of overtime services and holiday pay. Tavas also claimed for the cash equivalent of her SIL for 5 years and 13th month pay in 2009 and 2014 when she filed the Request for Assistance on October 1, 2014. Albeit the admittance, the employer said she could not afford to pay in full all of Tavas’ claims.

 

No agreement was reached during the initial conference on October 3, 2014 after the employer offered Tavas the amount P20,000 while the latter asked for P50,000.

 

“They were both convinced at the beginning to bring the matter to compulsory arbitration if one does not give in to the other’s demand or offer,” Odsey said.

 

On October 9, 2014, Tavas went down to ask for P40,000. “Our desk officer was able to facilitate a raise from the employer’s offer and bring it up to P30,000 with the employer hoping to close the matter with her niece. She appealed to her niece to accept her offer fearing that she will not be able to pay her other employees if she had to pay her demands.

 

Tavas was given the pro’s and con’s of either accepting the offer or not and after due consideration, she decided to take her aunt’s offer in cash. “They were both glad to peacefully resolve their issues and were thankful to us that they did not resort to judicial proceedings after all,” Odsey noted.
